How long is a Car Accident on my Driving Record?

The length of time that an auto accident stays on your driving record varies

depending on which state you live in. Each state sets its own laws and guidelines regarding the length of time that violations and car accidents show up on the record. In addition, each state may list different information regarding the accident such as assigning or not assigning fault.

For example, California lists car accidents for three years while Texas keeps them on the driving record for five years. In Texas, if the accident is serious such as the result of your driving while intoxicated, the accident will stay on your record indefinitely.

Another example is the state of New York. New York records the accident for all drivers involved on each of their driving record regardless of who was at fault. New York doesn’t assign fault. The car accident remains on each driver’s record for the year in which the accident occurred plus three additional years. If the accident occurred in January, it will stay on the record for nearly four years. If it occurred in December, it will stay on the record for just over three years.
