Montana uses a point system known as the Habitual
Traffic Offender program. Under this program, certain traffic violations are assigned a point value. If you are guilty of these violations, you will have points added to your driving record. Some common violations and the points they are assigned are as follows:

If you accumulate 30 Habitual Traffic Offender points within three years, your license will be revoked for three years.

You must ensure that all of your passengers and you as the driver are properly restrained using seatbelts. Children under the age of two must be in a car seat. If you are caught without your seatbelt fastened, you will be fined $20. All people 17 and younger who are on a motorcycle must have a helmet on.

You must always yield the right of way to emergency vehicles when they have their lights or sirens on. If you can, pull to the right edge of the road and stop. Let the vehicle pass before you proceed.

All posted speed limits must be followed when driving in Montana. Interstates in rural areas have a speed limit of 75 mph, whereas interstates in urban areas have a 65 mph speed limit. Other public highways have a 70 mph limit during the day, and a 65 mph limit at night. Urban districts have a speed limit of 35 mph. Failure to follow the posted speed limit results in a fine and points added to your driving record. Montana does not have a law limiting the use of cell phones by drivers.
