West Virginia Lemon Laws Described as: West Virginia Lemon Law Chapter 46a, § 6A 1-9 CHAPTER 46A, ARTICLE 6A CONSUMER PROTECTION--NEW MOTOR VEHICLE WARRANTIES Under West Virginia Lemon Laws, consumers must lodge official notification of alleged vehicle non-conformity within the manufacturer's express warranty periods, or one year, whichever occurs later. As is common in most State Lemon Laws, the West Virginia Lemon Laws require consumers to allow a reasonable number of attempts to repair to be made before the manufacturer must consider replacement of the vehicle or refunding of purchase funds. West Virginia Lemon Laws also provide for the intent of "reasonable number of attempts to repair" to be met by non-conformities continuing to persist and by a non-conforming vehicle being out of service for 30 days or more; during warranty terms and periods.
